Pursuant to K.S.A. 22-2906 et seq., the Shawnee County District Attorney's Office (DA) has established a Diversion Program. You may be eligible to participate in the Diversion Program. Diversion is a contract between you and the DA. Upon entering into a Diversion the court proceeding will be stayed. If the terms of Diversion are fulfilled the DA will dismiss the charges. Should you fail to fulfill the terms of Diversion the DA will revoke the Diversion. The matter will then proceed to a bench trial on stipulated facts and, if convicted, you will be sentenced by the Court.
Not all offenses are eligible for Diversion. Depending on the circumstances of the offense and your criminal history you may not be eligible for Diversion. Time is of the essence in applying for Diversion and unnecessary or unreasonable delays in applying may affect your eligibility. The DA will agree to one (1) continuance of your court date to allow you to apply for Diversion. If your offense involves traffic infractions and you wish to apply for Diversion, DO NOT pay your ticket immediately. Payment on a traffic ticket results in a conviction being entered and Diversion will no longer be an option.
